Dwayne Thomas

Dwayne Thomas, 58, and his roommate left their shared residence in the 9600 block of Cedar Glen Drive to join a small gathering watching college football on Saturday. Police said the roommate, Marvin Byrd, 54, shot Thomas in the 5700 block of Henner Avenue, put his gun on the ground and sat in his vehicle until officers arrived at about 6:30 p.m. Police said Byrd then fought against officers' efforts to put him in handcuffs. Byrd initially told police that Thomas charged at him, later said the shooting was accidental, then that it resulted from a "long build-up of frustration" with the victim, police said. Court records said an eyewitness heard the shooting and then saw Byrd standing in the street with a gun while the victim was on the ground. Byrd was charged with first-degree murder and armed criminal action in the shooting. He also was charged with resisting arrest and unlawfully possessing a firearm.
