The fatal shooting of a Lincoln County man on appears to be "a lawful case of self-defense," County Prosecutor Mike Wood said Tuesday. Wood said, however, that the investigation is continuing in the death of Kevin M. Davis, 38, and a final determination hasn't been made. Wood said initial findings show that the shooter, a man Davis knew, was attacked and strangled as he was sitting in his vehicle outside Davis' home in the 300 block of South Highway W near Elsberry. The vehicle door had been opened and Davis was on top of the shooter. Wood said Davis had been in a relationship with the mother of the shooter's children and that the shooter had gone to the home to take one child to a dental appointment. Wood said preliminary autopsy findings corroborate the shooter's statements. Wood added that forensic analysis of blood in the vehicle, the bullets' trajectory and analysis of the wounds tend to show that Davis was shot while he was on top of the shooter. Wood also said the victim's vehicle had been used to block the shooter's vehicle and that "signs of urgency" seem to have been present because Davis' vehicle had been left in drive as he ran toward the shooter. After the incident, which took place around noon Monday, the shooter was taken into custody for questioning and was later released.
